Ukrainian Government has amended the rules of leasehold land

The Cabinet of Ministers of Ukraine adopted a resolution on introducing amendments to the standard lease of land, which improved the mechanism for the preserving and reproduction of soil fertility, and also increased liability in case of late payment for land rent.

The Ministry of the Agrarian Policy and Food of Ukraine informs that the decision will help protect the interests of land plots owners, as well as increase revenues to local budgets.

The adopted amendments include:

  • fixation of indicators of qualitative characteristics of the soil cover of the land plot in the lease agreement at the time of its transfer to lease;
  • compensation of loss to the lessor/the owner of the land plot in case of deterioration in the quality of the soil cover of the leased land plot or bringing it into an unusable condition for its intended use;
  • establishment of the term of rental payment for the use of the land plot and strengthening of liability in case of its untimely payment (fine, penalty).

These changes to the standard land lease agreement were developed and adopted in pursuance of paragraph 3 of the Resolution of the Cabinet of Ministers on June 7, 2017 No. 413.
