Double land lease agreements stipulated 80% of appeals to the commission under the Ministry of Justice

Most of the appeals sent to the Commission for the review of complaints in the field of state registration of rights under the Ministry of Justice of Ukraine concern double land lease agreements.

This was told by Elena Sukmanova, Deputy Minister of Justice for State Registration, in the interview with AgroPolit.com.

"Almost 80% of the Commission's complaints concern double registration of lease agreements. On the one hand, now is the harvest time and there are those who wish to get it illegally. On the other hand, there is no notarization of registration of lease contracts. The point is: last year an anti-raid law was adopted that limited the possibilities for raider seizures of corporate rights. We returned to the notarial certification of the general meeting records, introduced criminal liability of registrars, and so on," the Deputy Minister of Justice of Ukraine said.

She noted that in the case of lease agreements there is no responsibility, so there are many cases of forging signatures, registering contracts for non-existent court decisions.

"Hence, situations arise when two enterprises enter the field and try to harvest," added Elena Sukmanova.

Elena Sukmanova explained that the Ministry of Justice does not keep accurate statistics on the number of complaints about double registration of lease agreements.

"There are about 80% of them per season. I can say that only this year the commission has satisfied about 200 complaints on land plots. As a result, more than 5,200 land plots with a total area of 7,000 hectares were returned to the owners," the Deputy Minister said.

Reference: the Ministry of Agrarian Policy and Food of Ukraine prepared a bill to improve the current procedure for state registration of property rights and use of land.
