Vinnytsya Court of Appeal recognized the admissibility of MHP facility construction

The Seventh Vinnytsya Administrative Court of Appeal on November 27, 2018, recognized the admissibility of the construction of poultry houses by the agro-industrial holding Myronivsky Hliboproduct (MHP) outside the village of Vasilevka (Vinnytsya region), Naparise.com informs.

By the decision of the chamber of judges, the National Environmental Center of Ukraine (NECU) was denied an appeal and the decision of the Vinnytsya Regional Administrative Court of March 20, 2018, was left unchanged.

According to Naparise.com, when considering the appeal, the NECU representatives accused the District State Administration that its order to approve a detailed plan for the land plot for the broiler chickens breeding facility had been carried out without going through a strategic environmental assessment procedure (SEA).

Having considered the case, the appellate court decided that the Tulchinsky District State Administration issued a lawful order.

In May 2017, NECU appealed to the court and demanded to declare illegal the regulation of Tulchinsky Regional State Administration No. 363 dated 11.18.2016 “On approval of a detailed plan of the territory of the land plot located outside the settlement on the territory of the Zaozernensky Village Council”, where Vinnytsya Poultry Farm breeding facilities were planned to build.

In 2016, the residents of Vasilevka were presented with the investor’s construction plans and the people supported the project. According to the Naparise information, the initiator of the location of the facility near the village of Vasilevka were the residents of the village.
